Terms & Conditions

The following Terms and Conditions must be agreed between Natasha Hatherall ("the Artist"), and the Buyer of Artwork(s) ("the Buyer") before an artwork may be sold.

These terms and conditions will use the term "Artwork(s)" for all artwork produced by Natasha Hatherall, the images of which being found on www.tishtash.co.uk, and "The Website" for the website address http://www.tishtash.co.uk

General

The Artist makes the following representations and warranties that her Artwork:

  • Is the Artist's unique work-product;
  • Is solely owned by the Artist, neither borrowed or stolen from, nor owned in part or in full by, any other party;
  • Is free and clear of all security interests, liens and other claims;
  • The Artist has full rights and powers of sale and transfer, there is no judgment outstanding against the Artist.
  • The Artist will sell Artworks as Originals.
  • The Artist is available for commissions.
  • The Artist will sell and ship Artworks to anywhere in the World.
  • These Terms and Conditions may be changed without notice.

Before purchasing Originals

  • The Buyer, or any person authorised by the Buyer may view the Artwork firsthand at any time agreed by the Artist and the Buyer, prior to any purchase. This is not a requirement but the Artist strongly recommends this for the sake of a satisfactory transaction.
  • An Artwork will be deemed sold once the Buyer has agreed to purchase it and has submitted payment in full.
  • The Buyer must check that the descriptions of the Artwork found on the The Website meet with their requirements before purchasing ie: dimensions, colours, media, ground, condition, frames, materials.

Purchasing Originals

  • All Artworks may currently be purchased with a debit/credit card through paypal, by cheque, bank transfer, cash, or PayPal.
  • If the Buyer wishes to purchase more than one Artwork then they will email or phone the Artist informing them.
  • The Artist agrees not to charge any fees (e.g. processing fees) other than the purchase price pertaining to the transaction and any associated postage costs, unless clearly stated.
  • Payment by Cheque - The Buyer agrees to notify the Artist by email or phone that they intend to pay by cheque. All cheques are to be made out to "Natasha Hatherall". The Buyer agrees to inform the Artist if they intend to make a purchase by cheque in any currency other than GB Pounds, in which case the current exchange rate fee will be incurred. No cheques in currencies other than GB Pounds which do not include the current exchange rate fee will be accepted by the Artist. Cheques received by the Artist will take up to seven days to clear with the bank before the Artwork can be released.
  • Payment with Cash - The Artist accepts no responsibility for cash sent by mail. If purchasing by cash in any other currency than GB Pounds the current exchange rate fee will be incurred. No cash in currencies other than GB Pounds which do not include a current exchange rate fee will be accepted by the Artist.
  • By electronic bank transfer - The Buyer agrees to inform the Artist by email or phone that they wish to pay by bank transfer. The Artist agrees then to send the relevant details to the Buyer by email. If purchasing by electronic bank transfer in any other currency than GB Pounds the current exchange rate fee will be incurred. No transfer in currencies other than GB Pounds which do not include a current exchange rate fee will be accepted by the Artist.
  • By PayPal - The Buyer agrees to notify the Artist by email or phone if they intend to make a purchase by PayPal. The Artist then agrees to send the relevant details of their Paypal account to the buyer by email. If using PayPal the Buyer may pay in US Dollars, GB Pounds, Euros, or Yen. The Artist agrees not to charge any exchange fees or any other PayPal fees to the Buyer.
  • By installments - Purchase can be made by installments at no extra cost. The Artwork will stay in the Artists possession and the Artist will remain the owner of the Artwork until the purchase price has been paid in full, after which time the Artwork will be released.
  • Shipping and Insurance - Shipping and insurance of all artworks is included in the purchase price for all sales within the United Kingdom. Shipping and insurance of all artworks is excluded in the purchase price for all sales outside the United Kingdom, the cost of each individual packaged artworks will be mutually agreed prior to any movement of the artworks.

Delivery, and delivery timing, of Originals

The Artist agrees that deliveries shall be handled as follows:

  • All Artwork shall be packaged and shipped in accordance with the Buyers specifications, or to shipping industry standards for items shipped.
  • The Artist shall be responsible for damage to Artwork caused from improperly packaging of item.
  • Shipping shall be done using shipping methods that provide for tracking and require a signature.
  • From the time the Artist's Bank has cleared monies paid for purchasing Artworks in full, to the time the Buyer has received and signed for the packaged Artwork, up to seven working days will be considered as acceptable within the UK.
  • Any Artworks to be shipped outside the UK will first be mutually agreed by the Artist and the Buyer specific to the individual country. Agreed times will be in accordance with usual shipping industry standard transit times.

Returning Originals

The Artist agrees that returns shall be handled as follows:

  • The Buyer may return an Artwork for any reason whatsoever within the period of, and including, ten days from the day the Artwork is delivered to an address specified by the Buyer, and signed for by whomsoever receives the packaged Artwork.
  • Any Artwork to be returned must be packaged using the same packaging material the Artwork was delivered in, unless the packaging was received by the Buyer, or representative of the Buyer, in a damaged and unusable condition. In which case the buyer will repack the Artwork using packaging similar to the original packaging.
  • The Buyer and the Artist will agree as to which method of delivery service will be used to return the original Artwork. Once an agreement has been made then the Artist and the Buyer will take immediate action necessary to carry out the return delivery.
  • Once the Artwork has been received by the Artist, the Artist will inspect the packaging and the Artwork.
  • The Artist will not refund any money for Artwork returned to the Artist damaged because of inadequate packaging.
  • The Artist agrees to refund in full any money for Artwork returned to the Artist in the same condition as it was originally sent, the Artwork being without any scratches, marks of any sort, tears in the canvas, holes in the canvas, scuffs to the painted surface, or chips to the paintwork.
  • The Buyer may return an Artwork if it has been damaged during transportation from the Artist directly to the Buyer, or to an address agreed by the Buyer and the Artist, in which case the Buyer will inform the Artist immediately on receipt of any damaged artwork, and will make immediate arrangements for the artwork to be returned to the Artist. The Buyer will ensure that the artwork is packed and shipped to the Artists requirements.
  • The Artist will pay for the return of the damaged artwork, and will refund the Buyer the total amount of the artwork.
